Welcome to ultimatepools.ca (the “Site”), operated by Ultimate Pool Service Inc. (“Ultimate Pool Service”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of this Site and your purchase of products from us through the Site.

By using this Site or placing an order through it, you agree to these Terms. If you do not agree, please do not use this Site.

2. Eligibility and Permitted Use

You agree to use this Site only for lawful purposes and in accordance with these Terms. You must not use this Site in any manner that could interfere with its operation or attempt to gain unauthorized access to any portion of the Site, its systems, or its data.

3. Product Information and Availability

We strive to ensure that product descriptions, pricing, inventory, specifications, images, and availability are accurate and up to date. However, errors, inaccuracies, or omissions may occur from time to time. We reserve the right to correct any errors and to update product information at any time without prior notice.

All products are subject to availability. Placing an order does not guarantee acceptance of that order or the availability of any product. If a product becomes unavailable after your order is placed, we may cancel the order in whole or in part and issue a refund for the unavailable item(s).

4. Pricing, Currency, Taxes, and Charges

Unless otherwise stated, all prices displayed on the Site are in Canadian Dollars (CAD).

Applicable taxes are calculated and displayed at checkout unless otherwise clearly stated. Shipping charges, remote-area surcharges, and other applicable charges, if any, will be shown before you complete your purchase.

Shipping charges may vary based on destination, parcel dimensions, carrier rates, and other order-specific factors. Additional charges may apply for certain rural or remote delivery locations.

5. Orders and Order Acceptance

Your submission of an order through the Site is an offer to purchase. We reserve the right to accept or decline any order, in whole or in part, for any lawful reason, including product unavailability, payment issues, suspected fraud, pricing errors, or other unforeseen circumstances.

An order confirmation email acknowledging receipt of your order does not constitute final acceptance of your order. A binding agreement is formed only when your order has been accepted and processed by us.

6. Payment

Payment must be received and authorized before an order is processed. By submitting payment information, you represent and warrant that you are authorized to use the selected payment method and that the information provided is accurate and complete.

7. Shipping and Delivery

We currently ship using carriers such as FedEx Ground, UPS, ICS, and Canada Post, or other carriers selected by us from time to time.

Estimated delivery times are provided for convenience only and are not guaranteed. We are not responsible for shipping delays caused by carriers, weather, service disruptions, customs, or inaccurate or incomplete shipping information provided by the customer.

Risk of loss and title for purchased goods pass to the customer upon delivery of the order to the applicable carrier, unless otherwise required by applicable law.

Free local delivery, where offered, is limited to eligible areas designated by us and may change from time to time. Eligibility may be determined by postal code at checkout. Some rural or remote areas do not qualify for free shipping or free local delivery, and additional fees may apply.

8. Curbside Pickup

We offer curbside pickup at our store location for eligible orders.

• Orders placed before 3:00 PM EST, Monday through Friday, may be ready for pickup within 1 business day, if in stock.
• You will receive notification when your order is ready for pickup. Please do not attend for pickup until you receive that notification.
• For security and fraud-prevention purposes, government-issued photo identification may be required, and the name on the ID may need to match the name on the order.

9. Returns, Refunds, and Exchanges

We accept returns on most new, unopened items within 30 days of delivery, subject to our Return & Exchange Policy and any product-specific exclusions.

Items that have been installed, used, damaged after delivery, or affected by improper handling may not qualify for return. Defective products may be subject to warranty review rather than standard return eligibility.

10. Order Changes and Cancellations

Because orders are processed quickly, changes or cancellations may not be possible once an order has been submitted. If you need assistance, please contact us as soon as possible. We will make reasonable efforts to accommodate your request but cannot guarantee that changes or cancellations can be completed after submission.

11. Warranty

Many products sold on our Site are covered by a manufacturer warranty. Warranty periods, coverage, and exclusions vary by product and brand.

Ultimate Pool Service provides in-house warranty support for eligible products. If you contact us regarding a product issue that may be covered under warranty, we will review the issue and, where applicable, handle the warranty process directly.

Where appropriate and subject to product availability, we may replace a defective product directly from our inventory. If a direct replacement is not available, or if manufacturer authorization is required, we will facilitate the warranty claim process with the manufacturer on your behalf.

Any replacement, repair, credit, reimbursement, or other warranty remedy remains subject to the applicable manufacturer’s warranty terms, product inspection, and approval requirements where applicable.

Labour costs, including installation, removal, diagnostic, or service-call charges, may be covered only where expressly provided under the applicable manufacturer’s warranty terms and confirmed by us or the manufacturer. Labour coverage is not guaranteed unless expressly stated in writing.

Customers are responsible for ensuring proper installation, operation, winterization, maintenance, water chemistry, and use of products in accordance with manufacturer instructions. Damage caused by misuse, abuse, neglect, improper installation, improper maintenance, freezing, chemical imbalance, unauthorized modification, or normal wear and tear is not covered.

12. Privacy

Your personal information is handled in accordance with our Privacy Policy and applicable Canadian privacy laws, including PIPEDA where applicable.

13. Accuracy of Account and Order Information

You agree to provide current, complete, and accurate billing, shipping, and contact information for all purchases. We are not responsible for losses, delays, or additional costs arising from inaccurate or incomplete information submitted by you.

14. Promotional Offers and Pricing Errors

From time to time, we may offer promotions, discounts, rebates, or special pricing. Such offers are subject to the terms stated with the promotion and may be modified or withdrawn at any time to the extent permitted by law.

If a product is listed at an incorrect price or with incorrect promotional information due to typographical error, system error, supplier error, or other mistake, we reserve the right to cancel or refuse any affected order and issue an appropriate refund if payment has already been processed.

15. Site Content and Intellectual Property

All content on this Site, including text, graphics, logos, images, product descriptions, and site design, is owned by or licensed to Ultimate Pool Service Inc. and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, transmit, display, or otherwise use Site content without our prior written consent, except as permitted by law.

16. Disclaimer of Warranties

Except as expressly stated on this Site or in a separate written policy, the Site and its content are provided on an “as is” and “as available” basis without representations, warranties, or conditions of any kind, whether express or implied.

However, nothing in these Terms is intended to exclude, restrict, or modify any rights, remedies, warranties, guarantees, or conditions that cannot be excluded or limited under applicable law, including applicable consumer protection legislation and any non-waivable implied conditions or warranties.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Ultimate Pool Service Inc. will not be liable for any indirect, incidental, special, punitive, or consequential damages, including loss of profits, loss of revenue, loss of data, or loss of use, arising out of or relating to the use of the Site or the purchase or use of products sold through the Site.

To the fullest extent permitted by applicable law, our total liability for any claim relating to a product purchased through the Site will be limited to the amount paid by you for that product.

This limitation applies only to the extent permitted by law and does not limit liability where such limitation is prohibited by applicable law.

18. Indemnity

You agree to indemnify, defend, and hold harmless Ultimate Pool Service Inc. and its directors, officers, employees, and agents from and against claims, liabilities, damages, losses, and expenses arising from your breach of these Terms or your misuse of the Site, except to the extent caused by our negligence, misconduct, or violation of law.

19. Governing Law

These Terms and any disputes arising out of or relating to the Site or any purchase made through it are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict of law principles.

20. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated effective date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms, subject to any rights you may have under applicable law.
